By downloading or using the Fishgram Aqua application (‘Fishgram Aqua App’), these terms and conditions of use will automatically apply to you. You should make sure therefore that you read them carefully before using the Fishgram Aqua App. If you disagree with any of these terms, you are prohibited from accessing this Fishgram Aqua App.
Fishgram Aqua App and its features are exclusively reserved for business users in India for fish and seafood products. Unauthorised use or illegal trading activities through the Fishgram Aqua App is strictly prohibited. Stringent action including but not limited to criminal action shall be initiated against such user in accordance with the applicable laws in force. You agree and abide by the terms and condition of use of this application and accordingly accept the Fishgram Aqua App on ‘as is’ basis.
You are prohibited from exchanging chats in a code language and not allowed to copy, or modify any part of the Fishgram Aqua App, or our trademarks in any way. You are not allowed to extract the source code of the Fishgram Aqua App, and you also shouldn’t translate the Fishgram Aqua App into any other languages, or make any derivative versions. Fishgram Aqua App and its trademarks, copyright, domain, application, database rights and other intellectual property rights related to it, exclusively vests and belongs to Infifresh Foods Private Limited (‘Infifresh’, ‘we’, ‘our’ or ‘us’) with its offices at No. 86, Uday Mansion, Industrial Layout, Koramangala, Bengaluru 560 095, India.
Certain functions of Fishgram Aqua App will require the Fishgram Aqua App to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but cannot take responsibility for the Fishgram Aqua App not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your mobile data left. If you’re using the Fishgram Aqua App outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the Fishgram Aqua App, or other third-party charges. In using the Fishgram Aqua App, you are accepting responsibility for any such charges, including data roaming charges if you use the Fishgram Aqua App outside of your home territory (i.e., region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the Fishgram Aqua App, please be aware that we assume that you have received permission from the bill payer for using the Fishgram Aqua App. Also, you need to make sure that your device or handset stays charged – if it runs out of battery and you can’t turn it on to avail the service, we cannot be responsible.
Fishgram Aqua App stores and processes personal data that you have consented to and provided to us, in order to provide our service. It’s your responsibility to keep your phone and access to the Fishgram Aqua App secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Fishgram Aqua App won’t work at all or may be subject to limited use.
You agree and acknowledge that certain Sponsored Content may be placed on, about, or in conjunction with the other content within the Fishgram Aqua App. In order to access the Fishgram Aqua App, you have to register as a user by providing prescribed information which will be governed by our privacy policy. For the purposes of this Terms and Conditions of Use, “Sponsored Content” shall mean, the content distinct from other regular editorial content displayed on Fishgram Aqua App, in the form of text, audio, video, image or other media (such as “Source”, “Ad” and “Sponsored by”).

Under no circumstances we shall be held liable for any losses, delay or failure or disruption of the content or services delivered through the Fishgram Aqua App resulting directly or indirectly from acts of nature, forces or causes beyond our reasonable control, including without limitation, internet failures, computer, telecommunications or any other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, flood, storms, explosions, Act of God, war, governmental actions, epidemics, pandemics, curfews, lock-down, orders of domestic or foreign courts or tribunals or non-performance of third parties.
Any data points, weather forecast and location, survival and growth related data, information and advisory services to industry, society, the government and the scientific community provided by a third-party either alone or through collective efforts with others including observations and constant improvements through systematic and focused research in information management and ocean modelling is provided by such third-party directly and we disclaim any control in such website, application, app or domain provided by such third-party.
The Fishgram Aqua App is designed to provide you an in-app browsing experience through an embedded browser. The Fishgram Aqua App summarizes third party content within one platform for easy access by you and for assisting you to find corresponding content of your interest.
The Fishgram Aqua App does not host, display or transmit any content owned by third parties on its servers, unless we are permitted under the applicable laws to do the same. When you read a summary, you will be provided with a link to one of the online sources of such summary. If you chose to access such link, you acknowledge and accept that you are leaving the Fishgram Aqua App and we shall have no liability, obligation or responsibility for any data breach, losses or damages arising thereof from your use of such online sources on third party sites. You agree and acknowledge that Infifresh is only an intermediary and that the Fishgram Aqua App does not provide any content of its own accord and Infifresh is not responsible and/or liable for the content or accuracy of the summary of content that may be accessed by you through the Fishgram Aqua App.
The Fishgram Aqu App may include links to other mobile applications and/or websites (some of which may be automated search results) which may contain materials that are objectionable, unlawful, or inaccurate. We do not endorse or support these links or the products and services they provide; these links are provided for your convenience only. We are not responsible or liable for the content or accuracy of such links
At some point, we may wish to update the Fishgram Aqua App. Fishgram Aqua App is currently available on Android and iOS – the requirements for system (and for any additional systems we decide to extend the availability of the Fishgram Aqua App to) may change, and you’ll need to download the updates if you want to keep using the Fishgram Aqua App. We do not promise that we will always update the Fishgram Aqua App so that it is relevant to you and/or works with the Android and iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, we may also wish to stop providing the Fishgram Aqua App, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the limited rights and licenses granted to you in these terms will end; (b) you must stop using the Fishgram Aqua App, and (if needed) delete it from your device.
We value your trust in providing us your personal information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and we cannot guarantee its absolute security.
We may conduct research and development of this application and therefore, Fishgram Aqua App is provided to you as a free-for-use application. We reserve all our rights to charge the required fee in our forthcoming version(s) and developments. We disclaim any and all responsibilities (whether injury or death) whether direct or indirect, you experience as a result of relying wholly on this functionality of the Fishgram Aqua App. The Fishgram Aqua app is only a service platform which is helping shrimp farmers. The present version of the Fishgram Aqua app does not support or enable any commercial transaction with respect to payments or fulfilment of an order. We do not provide any confirmation in relation to the credentials of any shrimp farmer listed on the Fishgram Aqua app.
The contents, links and the images provided in the Fishgram Aqua App are only for information purposes and does not in any way asks you to buy any of the products or goods or services.
The contents, links and the images or any information available on the Fishgram Aqua App is provided “as is” and “as available” and without warranties of any kind either expressed or implied, including but not limited to:
Your correspondence or business dealings with, or participation in promotions of, Sponsored Content or activity providers found on or through the Fishgram Aqua App, including payment and delivery of related products or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such provider of Sponsored Content. We will not be responsible nor liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such Sponsored Content on the Fishgram Aqua App
To the maximum extent permitted by law, we make no representation or warranty about the validity, accuracy, correctness, reliability, quality, stability, completeness or accurateness of any information or services provided on or through the Fishgram Aqua App; we do not represent or warrant that the manufacture, importation, export, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the Fishgram Aqua App does not violate any third party rights; and we make no representations or warranties of any kind concerning any product or service offered or displayed on the Fishgram Aqua App. Except as provided herein, to the fullest extent permissible by applicable law, our aggregate liability for any and all claims that may arise in connection with these terms shall not exceed Rs. 1,000/- (Rupees One Thousand Only).
UNDER NO CIRCUMSTANCES WE SHALL BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO ANY LOST PROFITS, LOST DATA, LOST USE OR ANY OTHER DAMAGES, RISKS, LIABILITIES AND CLAIMS THAT RESULT FROM YOUR PURCHASE OR SALE OF ANY PRODUCTS ON Fishgram Aqua APP OR ANY SERVICES AVAILED, EVEN IF WE ARE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WE EXPRESSLY DISCLAIM ANY AND ALL SUCH LIABILITIES, RISKS, CLAIMS AND DAMAGES.
We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
These terms and conditions are governed by the laws of India and courts at Bengaluru have jurisdiction over any subject matter pertaining to these terms and conditions including any disputes.
